$410 Million Settlement Shows Dangers of "Overdraft Protection" A federal court in Florida, encompasses actions brought on behalf of consumers in 14 states who said that the bank processed debit transactions in order of size -- largest to smallest -- rather than chronologically. As a result, consumers were more likely to overdraw their accounts -- and once they overdrew once, subsequent overdraws were more likely to occur, causing some consumers to accrue hundreds of dollars in fees. Along with Bank of America, the suit named two dozen other banks as defendants, including JPMorgan Chase, Citigroup, Wells Fargo, U.S. Bancorp, SunTrust, & Huntington Bancshares.

I was away from home for a few months and got the notice of the lawsuit and how to file a claim in my mail when I got home, but by the time I got it the deadline had passed. I dont have any accounts there, but used to have stock in a bank they took over, so it is now B of A stock.

My neighbor was getting my mail for me, but thought it was junk mail. They should have sent it registered mail so that I could have joined in the suit.

Guess they will use the money Im not getting to pay their execs their bonuses

CitiMortgage bought my fixed rate loan before i even made a payment 1st mo.and raised payment by 200 dollars. at the time they told me that thier policy is to double amount of escrow. Now that it's going into foreclosure thier story changed.

I do NOT have a Bank of America Account; nor have I ever had one. And I have never received an email from them either.

It went right to SPAM.

BOA is stalling home loan modification

I have been working with...well really against boa for loan modification. This has been going on for well over a year.they say they have no record of request for modifavtion even though I have the documents in my hand. Then they get my papers and intentionally do not scan in all docs. Everytime I call its "we are missing ..this or that.." the same crap I keep sending over and over. Its always " its being escalated..or under review" . We are not stupid boa..we all know you stall to force people to spend the money to refi! There has to be a way to complain and be heard! Think I will start contacting congressmen and other agencies and start filing complaints about boa in every forum I can! Arly4567@***.com

Seizures by U.S. Bancorp and Wells Fargo overturned

"The Massachusetts Supreme Court has overturned the foreclosures on two homes in the Bay State, sending a shock wave through the banking industry.

The Massachusetts justices ruled that neither U.S. Bancorp nor Wells Fargo have proved they had a legal right to evict homeowners when they filed foreclosure papers on the two properties in 2007.

Legal experts were quick to point out that the issues raised by the justices were specific to the two cases in question and won't impact other foreclosures, but it was nonetheless viewed as a legal shot across the bow of the banking industry. Bank stocks sold off sharply in Friday's trading after the decision was made public.

The courts ruled that both Wells Fargo and U.S. Bancorp had not actually been assigned the mortgages before they filed papers to foreclose. Instead, the banks began the foreclosure proceedings, then gained ownership of the mortgages.

The ruling comes at a bad time for banks, but provides some measure of hope for homeowners fighting foreclosure. Revelations of lender abuses and sloppiness have triggered a number of investigations. In fact, late last year ALL 50 STATE ATTORNEY GENERSLS launched a joint investigation into foreclosure practices. In addition, some states have unilaterally sued various loan servicers.

As a result, fewer homes are the subject of foreclosure, reducing the inventory of foreclosure properties coming to the market. The U.S. Government reports foreclosure activity fell 21 percent from October to November, the largest one-month drop in five years.

Ironically, a slowdown in foreclosures could actually provide a respite for the beleaguered housing market, which has struggled to gain traction over the last two years. With fewer foreclosures coming to market, most of which are priced well before other homes, housing experts say it could help real estate prices recover faster."

I wrote to the president of B of A got an immediate response, as I have been in B of A *** for six months. BUT, here I am six months later with NO modification, got an upgrade send me this and that person, then get offered .25% interest.

OK, so guys I have played long enough.

Am just gonna stop payments end of this month. Then can we talk B of A?

I am beyond scared at this point . I have been making trial modification payments for 1 1/2 years, they either lose my paper , applied my payment to another account or tell me its being reviewed still .

I sought help from NACA a negotiator took all my financial information and sent BOA proposal, that was done 10/26/10 . On December 14th I received notification that the proposal NACA sent over was denied and to reapply when my financials looked better . I called BOA and was told an intent to sell letter was sent and expires on 1/14/2011 and that there was nothing else they could do. The lady I spoke with said I was $12,000 behind I asked her " we what have you been doing with the payments i have been sending in?" She had no response .

I feel like i have just been throwing money away and feel so helpless . I dont know what else to do .

After 3 years I finally managed to get a permanent modification paid for with my blood, sweat and tears among other things. I signed it in September and since then have never heard one word, I'm still paying the higher amount and my own insurance and they are not crediting my payments to my account and are sending me letters indicating that without some change I could be foreclosed on. these people do not deserve to have a job or a company.

I would like to know a real true identity working class small business citizen that actually got one..non-profits only??????? hate for someone besides the bank to PROFIT..what is the point of American banks that are not american? seen the "STORY OF US" on the history channel?? we are blinded by glory.. the only real purpose of todays banks is to count YOUR money, invest in philanthropy. improve the public image.. next they will post checks on the wall like walmart does.. so you can see how much of your money went somewhere else.. just think how many starving Ethiopians, Haiti victims, you can save.. if all your money didn't go to cheap plastic (consumer junk) at walmart and credit cards. What to do to get your Home Modification Loan

I have read so many complaints that could have been written by me in regards to trying to get a home modification loan from BOA. They told me the same thing... will receive a FedEx package with papers to fill out. Never got it. I called BOA's customer service every day, and talking to about everyone, but never one more than once. I found that the only thing that will get their attention is to FILE A COMPLAINT WITH YOUR STATE ATTORNEY GENERAL. You will then get some attention. After the Attorney General sent a complaint to BOA on my behalf, I finally got a call back, plus an offer to modify our home loan. Problem was, our house had already been foreclosed. The lady from BOA said we should have contacted the Attorney General sooner. (crazy answer) It's all been a nightmare and you will most likely be ignored and won't get your loan. So if I get anything out of this, it is to help someone else from losing their house. File a complaint with your state Attorney General now! Do not wait. You can file online. Good luck!

BANK OF AMERICA PERMANENT MOD NOT HONORED

After jumping through all kinds of hoops to get a trial modification and then a permanent modification, I finally got word I qualified. The terms were a little vague and no one to ask about it but I was advised it was in my best interest to sign by both BOA and financial adviser so I did and now 3 months later they still have not credited my account and I get hangup phone calls and letters from Bank of America saying I am behind and could lose my home. These people are lower than earthworms. It has taken me years of working on this, sending stuff, faxing stuff, calling, writing, over and over again to get this modification. Before BOA and the other banks screwed up the economy I had about $40,000 equity in my house and now I got nothing and they are still arrogantly screwing the people of America who are having this problem through no fault of their own.

Bank of America lied for 9 months about MHA

After applying for a MHA to lower my monthly payments, which they said I qualified for due to job loss and more, I went through nine months of waiting and checking. They told me they had received all paperwork and it was being processed. After three months, someone in India told me they had no record of anything and I was advised to resubmit 20 pages over again.

After six more months of waiting and checking every two weeks and being told my loan was being processed, being reviewed at various stages with the negotiator, the underwriter and the investor, that a final modification was eminent, they informed me in writing that I did not qualify for MHA. When I called and complained and asked if everything they had told me for months was a lie, the response was, "well, sort of." At least he could speak English.

I am furious for the mental and emotional strain I endured due to Bank of America leading me on into a vacuum. In spring of 2010 they suddenly had a large bank of customer service people to answer the phone and say, "I apologize" and give out empty information. I have no doubt that Bank of America knew it was scamming people. Had I known MHA was not an option for me, I could have sold my house before its value plummeted another $50,000 during the time B of A kept me on the hook with absolute lies. It is totally incomprehensible that they could not tell me I didn't qualify within a few weeks, even though they initially told me I did qualify. How can Bank of America get away with this?

I lost about $35,000 in Bank of America and Fannie Mae stock. Bank of America deserves the boot along with Merrill Lynch...and ALL the big guys should take the fall, but I imagine that is too many to count. Actually, I think the whole MHA program is a complete lie, a federal scam that allows banks to get federal money while they lead homeowners on. The whole program is for the banks and an insult to the American people. We've been fleeced...big time! My faith in our whole country is quite thin.

I understand your pain and anguish and anger at being mistreated by these frauds. I went through 3 years of *** trying to get a modification and finally did get a permanent modification which helped slightly but now since I am still having to pay my own insurance and since they have not applied any of my payments I have not gotten an acknowledgment and I am still reported as delinquent and threatened with loss of my home. And I signed the permanent modification and they are still screwing with me and the number to call just goes to a call center where they transfer you over and over since they can't help you.

To this day still nothing has transpired: they claim that lost my paperwork; they are very busy; that they need more papers and more papers; and they even claimed in 120 days they will let us know if we qualified for anything. Mr. President! Here is another example why your policy "Make Homes Affordable for the People" have failed in regards to the population who are trying to make their payments to stay in their homes. You, your Vice President, and your Press Secretary, all preach this program every time you are on the television. The truth is Mr. President; you gave Billions of dollars to the hands of the very people that got us into this mess! Instead of placing qualified professionals, Real Estate Brokers from each State, on your "Make Homes Affordable Program" committee to consult with, you sought the information from inside people to make decisions for "we the people". Your program Mr. President has led to BOA telling us that since we are still able to keep our payments current, we are to move to the back of the line so they can concentrate on those already in default. So in essence that's what they are telling us to do, default, and get help! So here-in lies the dilemma that we are facing; either stop making our payments and receive low credit scores, in which time BOA will come back and say your credit is bad, or we walk away from our home, since with the economic crash, we have lost all our down payment of $ 180,000.00 anyway. Yes, we felt we did do the right thing! We actually put a down-payment down, our life savings, and we lost it and half of our home value as well. My wife is employed by the State of California in the medical field, and the Governor cut her wage by almost 15% by giving her furlough days without pay. I have had a forced retirement due to the conditions of the Real Estate market with a minimum fixed rental income. The people of BOA after a year and a half told me yesterday that my file is closed because my paperwork didn't get to them on time? Seven copies later in a year and a half as per BOAs request because something wasn't received again? And after spending 100s of hours on the phone with over 20 people. (I have names, times, and dates) Now, yesterday they tell me I have to start all over again? One compounding problem; in November 2009, BOA took it upon themselves to open us an impound account for our taxes and insurance thereby increasing our payment by $1,450.00 a month, all due to our application for loan modification. Was this intended to help us? So Mr. President, as you can see, the right hand does not know what the left hand does. On one hand they are telling us that we have to start all over again due to insufficient paperwork and our account is closed, and on the other hand they opened a impound account because we have an application in progress. These are the people Mr. President that you and your secretary, Mr. Gardner, trust with our tax dollars to help people like us, try to be good citizens and do the right thing. Your system breeds corruption. Mr. President I am a Greek-American Immigrant; a legal one I might say. I work hard to pay my taxes, to be a good neighbor, to work hard for the last 34 years and to save some money to buy our dream home. Now due to the BOA and Countrywide's loan programs, we are in the danger of losing our home. And just as another side note, we never even signed our loan application with the countrywide agent. He did all this in our behalf! When questioned, they say that since we were putting a 20% down, we qualified automatically, so we never were shown the loan application. I have repeatedly asked the BOA people to provide me with my loan application and they continually find excuses why they cant find it. Mr. President, as I have stated here, your programs and policies are failing because the people that you nominate to implement your programs are failing you. As a result you are failing with them, while we the people are suffering the continuances of your policies. We hope and pray that this letter comes to your attention to see it as an a wake-up call for the future of your Presidency and the future of the people throughout our great country that are suffering and are losing there homes. If this letter ever comes across your desk or across the desk of any of your people that are on television talking about how the program works and how you all trying to help people stay in their homes, I hope you feel some shame. As for Bank of America, they too should feel ashamed for taking your stimulus and helping so few. My experience of BOA, is they purposely, repeatedly lose documents in order to deny people of help and then take their homes back. They have nothing to loose Mr. President, because these loans are insured and they will get paid; by you and by us, the taxpayers. Seem we all have the similar stories here. Its so sad.

I was on the trial period for 14 months. After calling them and trying to get my mod permanent. They kicked me outthe program. There explanation was that my income was verified t $7,700 a month.

My income is exactly half that. Then they admited that there was an error but I would have to reapply. Upon reapplying over the phone. I was told I do not qualify.

So after 14 months of getting the run around. I decided to give up and stop paying my mortgage. Its amazing how the people on the bottom always get the short end of the stick. This country is not by the people or for the people.

Its for big business. It hurts to give up a home.

So I give up. just going to sit here until they foreclose.

I applied for a Making Home Affordable loan about 3 months ago. According to the bank it has passed the first reviewing committee.

The crazy thing is that they added my Property Taxes to the payment increasing my monthly dues. I already have a hard time making my payment and Bofa increases the payment. Now I am past due on 3 months and receiving late fees. PLus I am being trakced down by BofA payment center.

I called them telling them that they never notified me about the increase and now I am pass due and my credit is being affected.

According to BofA they are taking off the additional payment and reversing the late fees. We will see how it turns out.

Bank of America Home Loan or Retention Dept comprises of "untrained, thick faced, disorganized, no communication-lazy workers who, in the end, would say "NO" to loan mod. to struggling homeowners. They were paid to lie to us, using all the alibis (either they didnt receive the docs; pretending they are processing the papers; that they left a msg to me). I am not believing them anymore, even that negotiator, Paula, who I spoke with. All she cld tell me was that it's up to the investors who could finally decide if my loan cld be modified. Even so, I might not be able to afford it bec. my husband, my son and I were still in the negative.

How could she determine that when she was just making an assumption since she claimed our papers we sent were not complete (losing the expense sheet). My husband was so furious this morning that he had no choice but to raise his voice on her. BTW, she insisted that we were not responding to her assistant's call back. My husband told her that he was waiting for the call all day from the time we faxed the docs.

The bottomline was she said what she wanted to say bec. it was not her final decision. It is the "investors' decision. My husband became sarcastic with her asking her "what decision?" A DECLINATION of Modification? My husband up the phone with frustration and fatigue.

Meanwhile, I went to BofA website on their step by step h.a.m.a. I carefully went to that process tonite, and one of the pages asked me to enter the monthly income of all borrowers which was only me(my husband was not in the loan at all). I put the amt and my monthly mortgage payemtnt. I clicked on to the "recalculate" box, and it came out that my mortgage shld be lowered to $908.00 which I was, in fact, qualified.

But when they sent that letter in January 2010 that they accepted my trial loan mod, I was very hopeful and excited that I was given a chance by my lender. That letter instructed us to pay 3 months and even attached 3 mos. coupons and pay it by the 1st of Mar. April & May. No other fees would apply. In that letter it also stated that I would receive another letter within 30 days for the final status of my loan.

Days had past, I received no response. I was getting worried. I called their retention dept. and a manager told me that I shld have received a letter that I shld still continue to pay the modification payment after May. I was so furious and I told that rep. where in the first modification letter did they add that paragraph. I told her that 3 people were reading any letters from the bank to make sure that I did not miss any important context. Instead of apologizing, she was blaming for not paying June & July. Because of that a letter of denial was created.

I was so angry that I almost passed out. I was hyperventilating due to anger.

My husband intervened and he said that he wanted to escalate to a manager. David, the mgr. took the call and apologized (hopefully, he meant it). He finally gave the number to this Paula and that's when I had to start over again.

I spent freaking money just to have them faxed again at Staples ($2.00 per page) for nothing.

I will find more ways to stop this foreclosure and with the complaints I received from you, readers, I am motivated to either send my complaint to the OCC and hire a probono lawyer. I cld not afford to pay anyone anymore. My husband was just laid off this past Friday and that hurts us more. The big shots earn millions of money with what we pay them. And yet they are not giving us the opportunity to keep our homes. I believe in Karma. May God bless my family and yours. Thanks for taking time to read my horrible experience with this heartless company.

I was in the 3 month trial period program with B of A, beginning August 2009,I was told to continue making trial period payments until they made a final decision regarding my loan. I was informed in June of 2010, I did not qualify for a loan modification.

They then told me since I was only making a partial payment, I am now 9 months behind in my house payment.

I never missed a payment before or during this period. Now they want my house.

Late fees when mortgage was on time

B of A has consistently charges us late fees even when the mortgage was on time. Interest was charged on top of that, then they took our payments and applied them to the bogus late fees. I have sent receipts over 10 times, and finally after 2 years, they reimbursed most of the late fees, but did not re-amortize the loan from the point of their mistake, and are consistently charging fees on top of fees. You can't talk with anyone, they are all in California, and you have to leave a message. They sent me a letter stating I needed to call someone, and the phone number is the same on I've been leaving messages on for over 10 weeks. No wonder people are walking away from their homes. This is very frustrating.

:( We have had the same problem. Never late on our mortgage, gigged with late fees.

The first time it happened we called them and they claimed they had not received our check. We stopped payment on the check and wrote another. Once we informed them that we had done this, they immediately and magically found our original payment!

Which, of course, was never missing in the first place since they were engaging in fraud.

I have gotten two refunds for late charges I paid just to be charged again. The rep went back a full year on payments and I had no late fees due. Now they say I owe $100 in late fees and I don't.

Yes, I have been making my payments and even got a permanent modification but that hasn't changed anything, they still report me as late and threaten foreclosure.

There is no one to call and talk to about it you just get transferred until you get tired and give up.

The same thing just happened to me. I made the payment over the phone with a live person he assured me there were no late fees.

Then I get a letter in the mail saying I have been charged a $91 late fee. I called immediately and as soon as I told the girl exactly what happened she immediately apologized and credited the charge without further question.

I guess they are just trying to see who falls for it. I HATE BANK OF AMERICA!!!

Bank of America Loan Modification Fraud Join Class Action Here!!!

Hello everyone! My name is Karen and I live in Little Rock, Arkansas. Bank of America issued me a loan modification approval in July 2009 and has not honored it. My credit is screwed. I anticipate the Sheriff on my doorstep any day. I have hired an attorney. That's what it is going to take to get my loan and life straightened out! There is HOPE! And NOT the kind offered by Washington and the likes of BoA!!! There are several cases in WA, CA and AZ handled by Bergman law firm. These attorneys have a hearing scheduled for Sept. 30th before the federal courts asking to join these states together into a class action suit. Here's what you need to do to get involved: Get your story into a word processing document 1,000 words or less (you will copy and paste your story, please no profanity). Then go to the following website to register: http://www.hbsslaw.com/cases-and-investigations/BoA_HomeLoans Then go get your paperwork out! Organize it! Start recording your phone calls with BoA. Call them often! Make notes of dates, names, and conversations. Document, Document, Document Everything! Next: Go back to your story. Make sure that you spell out "Bank of America" everywhere in your story instead of abbreviating it as BoA. This will help our posts show up better when someone Googles it!!! (I also include "loan modification fraud or scam.) Now! Copy and paste that sucker everywhere on the net. Let's get the word out! Your local media outlets need to hear your story! Since 9-2008 I have been approved 5 times and have sent signed documents back to BofA.. They finally returned a signed copy 4-2012 but immediately sent a letter saying it was still in remediation.

Had several since. The last I heard in 8-2012 it was done but then had letter saying loan was sold to another lender and the new lender showed immediately I was $4000 behind. The only thing they have done is stall taking payments from$983 to $1187. They also have added over $25000 in back interest to loan.

ANd 7.4 interest rates. I hope this information gets out to someone who it can help.

I have tried for a loan Modification for about a year and constantly they continue to lose my application which cause to stop all over and give themselves time to foreclosure on my home which I need drastically due to my Disability.

Charge for using the web

The Bank of America is now charging a fee for all transactions placed over the internet. The fee for Mortgage payments $0 to $8.99, is predicated on the date you make your payment. We are not talking about a late payment either. They also charge for Bill Pay, Bank Transactions, ETC. I thought doing business over the internet was easier for all businesses. I guess Bank of America needs more money to take better vacations. If you are looking for a Mortgage, stat clear of the Bank of America. Maybe it should be called the Bank of IRAN or something just as ***.

NO HOPE! Ban Of America lied to the hope help team and me.

In June 2010 I applied through Hope for a modification and kept fedex proof. My daughter in law was given the run around by them so I was careful to submit about26 pages of supporting documentation to them. My husband, who made over 100,000 a year, got hurt and is on workmans comp total disability and I am unable to leave him alone, since Sept 2009. We qualify for hope under both medical and financial hardships. In March after a major operation he got a blood clot and suffered many workman comp treatment delays and we incurred extra med bills and have lost both his and my potential to earn anything but his base disability payment. On Sept 22 2010, after hearing nothing I contacted Hope Help Team. The gal was great and spent 6 hours being hung up on but stayed with it until someone at BOA (Bank of America) would talked to us on a conference call. They named an underwriter and said he needed info and the guy pulled up half the info they needed and said he would note the file that they did have all items but now needed current bank statements (2 mos)and gave me a fax number. I faxed the statements. It is Nov 13th and I have not heard anything back. I get nowhere when I call. Today I reached a real person at BOA without getting hung up on. Se told me there was no such person as the underwriter I asked for and that it had never been to an underwriter. She also gave me a totally different fax number. This Bank knows our situation is heartless and driving me insane! Someone at Bank of America is a liar and they appear to be above the law. I think we should start a class action suit against them!

You should have used a third party to look out for your best interest. The bank is only interested in helping themselves not lose money.

They can always replace you!

I have the same sad story. It took them a whole year to lower my payment by $100.

I'm in such disgust with them, and now because of the trial period payments I was making my credit is in shambles. Thanks Bank of America for making our life a shamble.

Same story here - we've waited since June for an answer on our modification to no avail. Now we are in foreclosure and expected to pay their lawyer fees.

Loan Modification accepted-Still in Foreclosure-No Answers Given

I was offered a "Loan Modification Agreement" by BAC Home Loans Servicing, LP, which would add my arrears to the end of my existing loan and also change my APR and the loan to a "Step Rate Loan". I found the terms to be agreeable and accepted the "Loan Modification Agreement",(LMA), by following the directions given and submitting all signed and notarized documents and a cashiers check in the amount requested for the first month's payment. While awaiting news of their acceptance, a "Notice of Trustees Sale" was taped to my front door! So, I immediately called them and was told that the "LMA" had been accepted and not to worry, since the "computer" showed me as being current, no balance due and even a CREDIT of $1,671.14!! However, it also showed a pending sale date 3 weeks from that date! Again, I was reassured not to worry, it's just a "system glitch", where the system hasn't updated my loan file and to call back in a couple days and it should be done. When I called back, I was told the computer showed the "LMA" had been accepted on 10/26, I was "current", but still having a sale date of 11/22/10, but not to worry.....it will automatically be removed and to check back "next week". Next week, I called and was told that a "permanent modification" was received, had zero balance due and a $1,656.14 credit(lower than previously told) and a "New" sale date of 12/14/10! So I asked for a written confirmation as to the status of the "LMA", I was told all they have are "form letters" and therefore could not send me any type of verification of the "LMA", or anything else, for that matter. I am now very concerned as to why the sale date has not been deleted. I am also puzzled that they are not willing to provide any written "piece-of-mind" or documentation for me to hold if they do try to sell my house. If they still sell it, what recourse do I have?? Bank of America Pyramid Scheme

After earning my Life and Health Insurance license, I was recruited to work for the Bank Of america office in Wheatrige, CO. They promised unlimited leads, good commissions, exceptional bonuses, free training, free trips tp exotic locatios and on-going support, so I took the gig. What I got was minimum 10 hour days making hundreds of calls to elderly people who were so sick they had one foot in the grave. I was supposed to go to their homes and sell them life or medi-gap or some other insurance product. I met one lady who had been sold three different life insurance policies. I had to drive all over the front range. The idea was to send me out with other agents who would sell and then pay me 1/2 of their commission. But they werent selling anything either. After six weeks of driving hundreds of miles and working 10 and 12 hour days for no money at all, the mananger, "terminated my contract" because he thought I wasn't a "good fit". Basically, only the managers are making any real money because they get paid for every sale the agents make. I warn everybody to steer clear of this company either a a client or as an agent.

Hidden Costs

Whenever one chooses a service with them, there are many hidden costs that one will only discover once paid. For example, I canceled 3 lost checks, and now I discover that I paid a fee of 30 Dollars for it, where as there were no mention of such a fee at the moment of my request. Another example: I opened an saving account after asking if there is "any fee", and they told me no.Then I found out, if there is less than 600 Dollars on your account, there is a monthly fee that one need to pay. The worst is their client service: they told me that "we can close your account if you are not happy with our service!" The power of MONOPOLY!
