Bank Of America in Concord, California - Mortgage run around no talk to to get truthfull responce

I was put on a 5 year intrest only with the promise of future help at that time I owed 579. this was in 05 with countrywide in that time my loan went to bac home loans and then bank of America N A then to aurora msf lehman lx I have been in the mod qualification process since 09 and been told i qualify but then every time it seems before the final time they start with resend the same info month after month asking for past 3 months P.&L. well on 1 occasion i leave out 1 blank page from my bank statement so im denied modification yes this was also a repeat blank peace of paper received no less then 2 times prior so back to the start well of course before i can meat the deluge of repeat papers game the loan is sold again and then im told that a third party owns my loan and that they are not taking part in this mod process ive done research that states that the deed holder of the loan must contact with all there info this has never happened once and in fact this is case law in ca. please help my loan is now 606 my house value is 470 cms.64@live.com

I hear your frustration, but our story is a bit different. We did not do a loan modification, but BofA fraudulently reported that we did. I requested info on their loan mod programs, looked it over and determined it wasn't for us at the time, called them and said we weren't interested. Done. Right? No.

We applied for a refi and the credit reports that came back were s hocking. bofA reported "serious delinquency". And "paying under partial payment agreement" and our credit scores had dropped a hundred points! We have never been late paying our mortgage since we bought our house.

BofA disconnects me when I call and no one will respond. Meanwhile interest rates climb and we are unable to refi. I have filed a complaint with consumerfinances.gov in thre hopes that they will force BofA to respond.

If anyone has any advice please let me know

Bank of America failed Americans

1. Why did Countrywide change my 5.75% mortgage loan, I Locked-in at, to 6.25% right before signing escrow, without discussing it with me 72 hours prior as loan documents states must be done? 2. Why did Countrywide tell me I couldn't afford the cheaper loan and that they thought they told us prior already, when I called during signing? 3. Why did Countrywide change my loan to one I doubted my wife and I could afford, when my family was going to have nowhere to live if we didn't sign? 4. Why did Countrywide tell us their copy machine was broken when we signed our lock-in agreement? 5. Why didn't Countrywide give us a copy of our Lock-in agreement document when we asked for it since the beginning of our mortgage? 6. Why did Countrywide sell our note to Bank of America that we did not want to do business with nor support, and not hand deliver the note? 7. Why are we forced to do business with Bank of America and forced to allow them to service our loan? 8. Why did Bank of America ignore us on 5 modification attempts to our previous lock-in agreement and only answered and told once that we didn't qualify? 9. Why does Bank of America deny our QWR for all Loan, escrow, Lock-in agreement, and 6 modification attempts, documents? 10. Why does Bank of America Bank of America threaten to foreclose, selling our note, and actually put our loan into default with pre-foreclosure, still denying us our QWR? 11. Why is it legal for real estate companies and internet sites allowed to show our house available in pre-foreclosure, for 2/3 the cost I purchased it for, at a monthly mortgage half of what I am being forced to pay? 12. Why is it ok for Bank of America to foreclose on my mortgage when the amounts due are the same amounts our houses estimated worth has depreciated, due to Real Estate company's, Countrywide's and Bank of America's practices of unequal, racial, judgmental, predatory lending for greed of money with house flipping and greed of money, no matter who it puts on the street and causes to be homeless? 13. Why is it ok for the home builder to tell us they're not going to fix the cracks in our stucco unless they can fit a nickel inside it? 14. Why is it ok for banks to exercise their legal document rights, ignoring and denying the consumer their documented rights when the consumer cannot afford the greed of an attorney? 15. Why does everyone, banks, governments, other nations and countries think they can do what they do against Americans and God's true Children everywhere, and get away with it, without judgment from God? 16. Why did the American Government bail out these banks with tax payers money, for doing these things to Christian Americans that choose to be the True Children of God? Bank Of America in San Luis Obispo, California - Modification Nightmare

I've been embroiled with Bank of America *** for 2 years for home loan modification. I have Faxed, emailed, FEDX, thousands of documents, same ones 5 or more times. I call get Voice Mail to call 2 other #s, call 4 and get more#s, I call all and get referred back to original # Agents tell me to call the next week, I call they are gone. I am having serious health and mental problems from the stress. I have documented everything, spoken w/ congressional office. Is there an attorney who wil help me sue for contigency? SOMEONE Please HELP!

Since 10/1/10 I have been playing the stress game with boa. My income was cut due to my spouse walking out.

I have been told to get a quick claim deed ( did it) file for divorce (did it) write dozens of hardship letters. Everything they asked for I did. I was told to take in a renter; get a second job (trying to hold my full time down). Sell things .

I once told them that I will put my dog and cat on the corner (they are fixed). They don't want your home and they don't want you to keep it. I am swimming with the loan and they just keep adding fees and things to make it worse. The value is going back up now and I am being pushed into a short sale.

After 23 years this isn't a houe; it's my home with an edlery parent;20 year old cat and ten year old dog. They even offer me 15000 in relocation fees if I qualify. What do you think my chances are? If I do I dodn't get it ( taxes and everything) until after I am long gone.

A co worker said he will deal with boa because they won't go broke. Guess not when they really don't try to help those that need it.

If I had money in the bank or a mansion I caould get a mod just like that.

Different day, same story, I too have been going through the same with BOA. The latest: My husband called BOA a couple of days ago to check the status of our modification request only to be told by Jewel Stephens that we had failed to send in the application which is an absolute lie, we have actually sent in the application along with the required documents 8 times, yes you read that right on 8 separate occasions we sent everything in.

So, Jewel Stephens with Bank of America said that since we had not sent in the application and documents that they had now sent our file to Charlotte. (have no idea what that means). Also, in a very condescending tone told my husband that BOA does not do principle reductions now or ever. I mention the principle reduction because we had requested one on one of the applications that he said they had never received, obviously he was lying about not only the receiving our application but also regarding BOA not doing principle reductions.

We paid 650,000 for our home in 2005 it is now worth around 250,000 We have not yet contacted an attorney because we see so many scams taking place on people in similar situations. Does anyone have any insight to share?

Most if not all of us on this blog have been going through the same thing with BAC, we need to form a group and start a protest, something needs to be done and more help needs to be offered to all of us who qualify, wondering these politicians are doing for us...so much talk and no action serious people feel free to contact me at aurocarlos@aol.com lets start today and see if someone out there is willing to hear us and help change this corrupt system that Bank of America is using against all of us trying to keep our homes, I guess this government wants us to be dependant on them and soon there will only be the rich, no more middle class in this country its looking like socialism is on its way.... lets work together and maybe just maybe we can be the ones to make a difference and win our battles.

I have been going thru the exact same situtation with BOA. I even attend the Home Loan Modification seminar they had in my city and personally handed them the docouments.

Still denied me. They advised me they sent out an application and forms to fill out for the modification, I never recieved them. I called them 2 weeks in a row asking about the forms. One rep told me they sent them, another rep told me they did not send them yet, and a different rep told me they did not send them because I was denied.

I got denied before the "paperwork" was sent out? They can never tell me why I'm being denied. Wow....now I have to move? I am a single mother of 2 children with no child support(the father stop paying).

I wanted to keep our home and a modification is what I needed badly. The house was purchased when the market was really high and now the house is upside down by $70,000. The houses in my area do not sell. So let's see how long it's going to sit.

I have been making payments, but forget it. I will not send another dime.

I tried for over 3-years to get a loan modification from Bank of America. Bank of America has definitely practiced horrible and toxic financial business with me in regards to my home.

I am definitely a "Victim of Fraud," caused by Bank of America.

I eventually had to agree to a "Short Sale" on my property. Is it to late for me to join this Class Action Suit, filed in Southern California?

If you are upset at your lender and your current situation .. your best recourse if you are looking for justice would be to sue your lender in a court of law.

cantact me and see if your loan qualoifies for the lawsuit.. Unfortnuetly , loan modifcations are next to impossible to get because the bank has no motivation to do them.. They stand to make more if they foreclose and resell your house...

Bank of America screwed me out of my home

I'm at my wits end! My wife and I have been trying for over 3 years to save our home. The whole mess started with an IRS problem due to a flaw in the Turbo Tax Home and Business edition for 1999. The program deducted our home mortgage interest twice. IRS was super to work with Because, it was a flaw in the program they did not apply any penalties or interest. I asked a friend who I knew since 5th grade to help while my wife and I arranged for a loan to take care of the problem. He was a former IRS auditor and now with an accounting firm in Phoenix. This was back in 2002. Because my friend missed 3 deadlines the IRS became a little hard to deal with. The dollar amount jumped to $39,000. and IRS wanted it now. To complicate matters, I had lost my job because the company I was with since I was 17 went out of business and at that time I was 51 years old and we were the largest furniture retailer on the planet with 1018 stores. As a result the only loan we could get was a refi on our home, which later turned out to be labeled a "Predatory Loan" through Countrywide. We paid off IRS. Then in 2007 the loan became unaffordable, the interest had jumped to almost 11% with payments approaching $4,700. per month. The State of California had filed a law suit against Countrywide for "Predatory Lending Practices" and our loan was among those involved. That brings us to 2008 and the "Obama Make Homes Affordable" plan plus the acquisition of Countrywide by Bank of America. We had retained "Wall Street Modifications" to represent us with Countrywide related to the law suit and Countrywide having to fix these loans. Wall Street Modifications was a fraudulent company however, they negotiated a Modification for us at about the same time as BOA acquired Countrywide. The acqusition was approved by the Federal Reserve Board and as part of that approval BOA was to fix those Predatory Loans extended by Countrywide. Here is the statement from the Federal Reserve Board and I Quote - "...Bank of America should stabilize this massive portfolio (Countrywides questionable mortgage loans) by ensuring those borrowers can afford to keep their homes". The Modification through Wall Street was also unaffordable and Countrywide agreed, so that never went forward at their suggestion. Countrywide, under BOA control and under the "Obama Make Homes Affordable" plan came up with a new Modification plan with payments of $1,385. which were affordable and mailed it to us on December 24th, 2009. Payments were to begin on February 1, 2010 which we signed and returned to the BOA office where they originated from in Pittsburgh, Pa. and I have copies of the agreement. My wife called BOA to make our first payment on Monday February 1, 2010 and was told that for some reason BOA decided they were not going to go through with this plan and they would work something out and get back to us. We called and called and called, then in early April 2011 we were told that we might lose the home! That brings us to today a year and 2&1/2 months later BOA is now telling us we do not qualify under the Obama plan because of the past due payments are making the loan balance to high to fit a into payment related to our income. If they had honored the Modification of December 2009 there would not be any past due amount.

Names changed situation similar.. I became disabled in 2009 and was working with Countrywide to modify my primary mortgage had it all worked out too lower monthly payment, better interest rate, yeah I added a few years to the term but I would at least be able to afford the house on the joke that the Workers Comp was paying me.

BOA took over right as I was mailing my notarized and signed agreement in to countrywide...

Suddenly all deals were off.. Despite my circumstances BOA never processed me under the hardship provisions that they grabbed tax payers money for. Oh no..

they just screwed around letting me make the payments that I'd agreed to pay Countrywide because that was all I could afford. They of course kept piling up the unpaid amounts along with whatever penalties they could stick on... Then when I was around 10K underwater on the original loan they dropped the foreclosure bomb.. I said goodbye to my home on July 14th 2012

Now the State is contacting me about a "settlement" for BOA's bad faith actions..

but of course the lions share of the bucks squeezed out of BOA is going to keep people in their homes..

*** to be me since mines gone.. my group may see a 1 or 1.5K check less than 3 mortgage payments I'm sure BOA execs are laughing their *** off at the impotent States Attorneys Generals and the "penalty" they pay while they pick up homes for chump change...
